Acceptance of Terms and Conditions
By subscribing to any of our subscription tiers or utilising our services in any way, you are agreeing to comply with and be bound by these Terms and Conditions. This agreement is effective upon your first use of our services. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.
Immediate access and waiver of cooling-off period
By entering into this agreement and paying the subscription fee, you acknowledge and agree that you will be granted immediate access to our platform. Consequently, the 14-day cooling-off period, as outlined under Australian Consumer Law, will not apply. All payments made are final and non-refundable.
Subscription tiers
We offer four subscription levels, including a free option. Each level provides different features and benefits.
Payment requirement
Unless the free subscription is selected, payment in accordance with the subscription tier selected is required prior to the features of that subscription being made available. No access to the services is granted without payment, except for the free option.
Renewals
The subscription term is one year, which renews annually.
Renewal notices
Renewal notices will be sent out:
- 4 weeks prior to the renewal date.
- 1 week prior to the renewal date.
- On the date of the renewal.
Payment of renewal
Famography does not retain any credit card information. Subscribers are responsible for making their own payments
Non payment of renewal
If the renewal payment is not made by the due date, the account will be downgraded to a free version, and some data may be lost.
If the renewal payment is made within 3 months after the due date, the account can be reinstated.
Cancellation of subscription
Notice to cancel a paid subscription can be sent to Famography at any time. The effective date for the termination is the last day of the current term.
Subscription upgrades and downgrades
Upgrades
If the subscription level is upgraded during the one-year term, a pro-rata amount will become payable and must be paid before the service is upgraded.
Downgrades
Downgrading subscriptions can occur at the end of the term.
Refunds
Allowance may be made in certain circumstances for a refund to be issued. All future payments are made by the subscriber at will and are not subject to refund.
Redundant account policy
Inactive accounts
If a free account or a downgraded account has no activity for 12 months, Famography will send an email to the account holder advising of its intent to close the account.
This emailed notice will be sent 14 days before the end of the term
Account closure
If there is no response, the details of the account will be printed to a PDF and retained by Famography for a period of 5 years.
The account holder must make all requests in writing to retrieve their information. A storage and handling fee may be charged for this service.
Consumer guarantees
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with the service, you are entitled to cancel your service contract with us and receive a refund for the unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
Data privacy and protection
We are committed to protecting your privacy and ensuring the security of your personal information.
All personal information provided to us is handled in accordance with our Privacy Policy, which complies with the Privacy Act 1988 (Cth).
Modification of terms
Famography reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to users at least 30 days before they take effect. Continued use of the service after such notification will constitute acceptance of the modified terms.
